The following four research questions provided an important background against which the contents of this report were addressed

1. Is the concept of environmental protection during armed conflict not a contradiction in terms, considering the destructive and often indiscriminate nature of armed conflicts?

2. If the [answer to the] question is no, then the issue is raised, whether current international laws of war provide effective protection to the environment during times of armed conflict?

3. If the question is again answered in the negative, then the issue remains whether law reform is needed to re-address current international laws of war. If international laws of war dealing with the protection of the environment are to be overhauled, then in what context should it be done?

4. Is it possible to protect the environment from malicious military acts under the same principles that hold war criminals liable for the violation of human rights?
